Hereinafter, "DartMUD" shall refer to the internet online game and entertainment site or sites known individually and collectively as DartMUD, and/or any other related site or sites sanctioned by the DartMUD Staff (as defined below), including sites hosted under the domain names dartmud.com and surfon.com, and to any other material or media pertaining to the online game DartMUD sanctioned by the DartMUD Staff.

Above and hereinafter, "DartMUD Staff" shall refer to the staff, employees, operators, equipment and/or internet service providers and their employees or staff, and any person acting on behalf of any of the above, whether individually or as a group, for the purposes of providing the service known as DartMUD as defined above.

Above and hereinafter, "Users" shall refer to any persons regularly connecting to the online game known as DartMUD, visiting its official and related websites, and persons who interact on a regular basis with other Users with the intent to discuss or take actions pertaining to DartMUD. DartMUD Staff members may also be considered Users.

Above and hereinafter "Participating in DartMUD" shall refer to acting in any way as a User.

Persons under the age of 18 must have parental permission to participate in DartMUD.

Users participating in DartMUD are guests, and do so at the pleasure of DartMUD staff. No right of access is expressed or implied. DartMUD staff reserve the right to deny access completely or partially to any person or persons at any time without notice or cause.

Users agree to abide by all rules of the game.

Former Users who have been denied access by DartMUD Staff for any reason are specifically and expressly prohibited from attempting to gain access to the online game or any other computer system to which they have been denied access. Attempting to gain access to computer systems after having been prohibited from doing so may constitute a violation of applicable computer crime statutes.

Users participating as "registered members" (as defined in the rules posted within the game and at its website) are required to provide their legal name, and to keep on file with DartMUD Staff a valid and working e-mail address.

By connecting to DartMUD, users grant Dartmud staff permission to conduct routine security audits of the system from which they connect to DartMUD. Such routine security audits may include TTL examination, port scanning, Operating System fingerprinting, RPC enumeration, route examination, survey of services offered, and other similar tests. User asserts that he or she has the authority to grant such permission to DartMUD staff. User agrees to accept the risk of such probes, which could reasonably be expected to include system crashes and disclosure of illegal activity, and hold harmless DartMUD staff and Internet Service Provider. Users acknowledge that the outcome of such routine security audits could result in DartMUD staff denying permission for a particular system or network to connect to DartMUD.

Users agree that DartMUD staff shall be held harmless in the case of any act or omission related to any situation or occurrence pertaining to DartMUD. Furthermore, Users relinquish all rights to any claims based on any law or statute, including federal, state, local, or international law, in any country.

All DartMUD content, including computer programs and code, text, graphics, and other media are Copyright DartMUD Staff 1990-2005. All rights reserved. Unauthorized reproduction without permission is strictly prohibited. Persons who reproduce DartMUD content without permission may be in violation of the Digital Millennium Copyright Act and/or other applicable statutes.

Any data of any type transmitted by Users or any other persons to or through DartMUD and its related computer systems, and any data or material provided by any means to DartMUD staff and pertaining to DartMUD, may be monitored or logged by DartMUD Staff. By transmitting any data or providing any material to or through DartMUD or related computer systems and/or to DartMUD Staff, you grant unrestricted license for DartMUD staff to reproduce and/or publish such data or material.

Users agree that this agreement shall be governed by and interpreted pursuant to the laws of the State of Hawaii, and that this agreement shall be treated as if executed in Honolulu County, State of Hawaii, and as if performed in Honolulu, Hawaii, and that any action relating to this agreement shall only be instituted in Honolulu, Hawaii. Users specifically consent to such jurisdiction and to extraterritorial service of process.

All Users participating in DartMUD do so voluntarily and at their own risk. DartMUD Staff make no warranty, representation, or guaranty whatsoever about participation in DartMUD. Users should consult a physician prior to participation in DartMUD. Users under the care of a mental health professional should not participate in DartMUD. Users under the influence of alcohol or drugs should not participate in DartMUD.

By continuing to log in to DartMUD or otherwise continuing to participate in DartMUD, you agree to the above Acceptable Use Policy and Disclaimer of Liability in its entirety. If you cannot agree to this policy, and all other rules of DartMUD, you must log out and discontinue your association with DartMUD immediately. Failure to log out and discontinue your association with DartMUD constitutes acceptance of this agreement, and you agree to be bound by its terms in perpetuity.

DartMUD Staff reserve the right, at their sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such changes and/or modifications shall become effective immediately upon the posting thereof.

This agreement constitutes the entire understanding between DartMUD Users and DartMUD Staff with respect to the subject matter hereof. There are no understandings, agreements, conditions or representations with reference to the subject matter herein that are not expressly referenced herein or superseded hereby.
